By placing a bid, you are entering into a contract to purchase the item(s) should you have the highest final bid. You are bound by the terms and conditions of the auctions. In the unlikely event that your item is unavailable for pickup, your claim is limited to a refund of the selling price.

Pick-up times are always the Friday and Saturday following the auction, during regular business hours. By bidding, you agree to remove the items by the specified date, pay the late pick-up fee, or forfeit the items. Bring all necessary moving help and packing materials to remove your items.

This Auction is presented by Bunting Online Auction (Bunting) and is conducted under these Terms and Conditions as well as applicable State and local laws. By participating in the auction, the Buyer affirmatively represents and acknowledges that Buyer has read and understood the terms and conditions of sale set forth herein and agrees to be bound by the same. By bidding at a Bunting Auction Company auction, bidders and Buyer hereby agree to be bound by the following:

1. ALL SALES ARE FINAL. This is NOT a retail environment; this is a FINAL SALE AUCTION. There are no cancelations, returns, restocking, refunds, or exchanges. NO EXCEPTIONS. According to Maryland law a winning auction bidder automatically enters a legal and binding purchase contract with the auction house. Bunting Auctions has a ZERO TOLERANCE Policy regarding non-paying bidders and will pursue all available options to collect on any unpaid invoices. Storage fees and legal/collection fees may also be added to past due invoices.

2.Condition and Descriptions. Any condition statement is given as a courtesy to a potential Bidder or Buyer, is only an opinion, and should not be treated as a statement of fact. Bunting shall have no responsibility for any error or omission. The absence of a condition statement does not imply that a lot is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. Any statements made by Bunting with respect to a lot whether in a condition report, Bunting catalog, or on the Bunting website, orally or in writing, are intended as statements of opinion only, are not to be relied upon as statements of fact, and do not constitute representations or warranties of any kind.  All measurements and weights are approximate, rounded up to the nearest inch & provided for shipping estimation purposes only, with no guarantee of accuracy. If you require exact measurements, please use the "ask a question" button on the item page. Descriptions we make about lots may not describe all faults or restorations. Bunting undertakes no obligation to Bidders or the Buyer to examine, investigate or carry out any tests, either in sufficient depth or at all, on each lot to establish the accuracy or otherwise of any Descriptions or opinions given by Bunting, or by any person on Bunting’s behalf, whether in the Catalogue or elsewhere. Bidders and the Buyer should not suppose that such examinations, investigations, or tests have occurred. Illustrations and photographs of any lots are for identification purposes only. A photograph or illustration may not reflect an accurate reproduction of the color(s) or true condition of the lot. It is for Buyer to satisfy yourself as to each and every aspect of a lot, including its authorship, attribution, condition, provenance, history, background, authenticity, style, period, age, suitability, quality, roadworthiness (if relevant), origin, value and estimated selling price (including the Hammer Price).  No description or report about a lot is a substitute for your own examination of a lot.

It is the Bidders responsibility to ensure the condition of the lots meet with their satisfaction BEFORE bidding. Most items are preowned and will have signs of use. New items may have flaws or show signs of handling. ALL BIDDERS ARE ADVISED TO ASK QUESTIONS PRIOR TO BIDDING. While great care is given regarding condition classification, all statements regarding condition are opinion only, please review the photos carefully, Bunting Auctions assumes no responsibility for any error or omission. IF YOU ARE IN DOUBT THAT THE LOT WILL MEET WITH YOUR SATISFACTION YOU ARE ADVISED NOT TO BID. All lots are sold As Is and without recourse and neither Bunting nor the consignor makes any warranties or representations, express or implied, with respect to such lots. DO NOT BID ON ANY LOT UNLESS YOU ARE SATISFIED WITH YOUR OPINION OF ITS PROVENANCE, CONDITION, SIZE, AND WHETHER OR NOT IT HAS BEEN REPAIRED OR RESTORED. 

3. Buyer's Premium: All bids are subject to a Buyer's Premium which is in addition to the placed successful bid. The Buyer’s Premium for any one auction lot is twenty-eight (28) percent of the gross hammer price up to and including $20,000 and 20% for any one auction lot over $20,000.

Bidders.  Any person participating in or registering for the Auction agrees to be bound by and accepts these Terms and Conditions of the Auction.  All Bidders must meet Auctioneer's qualifications to bid. Any Bidder who is not a client in good standing of the Auctioneer may be disqualified at Auctioneer’s sole option and will not be awarded lots. Such determination may be made by Auctioneer in its sole and unlimited discretion, at any time prior to, during, or even after the close of the Auction. The Auctioneer reserves the right to exclude any person from the auction. If an entity places a bid, then the person executing the bid on behalf of the entity agrees to personally guarantee payment for any successful bid.

Bidding at Auction: The highest bidder recognized by the auctioneer will be the Buyer. The Auctioneer’s decision and declaration of the winning Bidder shall be final and binding upon all Bidders. The successful bidder will be personally responsible to pay the hammer price plus a Buyer’s Premium of twenty (20) percent of the gross hammer price up to and including $20,000 and 10% over $20,000 (Buyer's Premium), plus applicable sales tax. Title and ownership of the property purchased shall not pass to the Buyer until such time that all monies due have been paid in full. All unpaid balances shall bear interest at the highest rate permitted by law until paid in full.

Bids properly offered, whether by Internet Bidder or other means of bidding, may on occasion be missed or go unrecognized; in such cases, the Auctioneer may declare the recognized bid accepted as the winning bid, regardless of whether a competing bid may have been higher. After the hammer falls, the Auctioneer reserves the right to accept bids and reopen bidding for bids placed through the Internet or otherwise. Regardless of placed bids, Auctioneer reserves the right to withdraw any lot, or any part of a lot, from the Auction at any time prior to the opening of any such lot by the auctioneer.

6. The auctioneer reserves the right to reject a bid from any bidder. The winning bidder will be the highest bidder as determined by the auctioneer. The auctioneer has sole authority to resolve any disputes. Bunting Auctions will not be responsible for any failure to execute absentee, electronic or phone bids due to human error or electronic failures of any kind. The Auctioneer may pause or end the auction at any time.

BIDDING ERRORS.  BUNTING will not cancel the sale of an item due to an accidental click, technical error, or user error. Regardless of the circumstances, if you place a bid and subsequently win that item, you have purchased it. Bunting cannot be responsible for Bidders and Buyers errors in bidding or the entry of bids. In the event of any dispute between any Bidders at an Auction, Auctioneer may at their sole discretion reoffer the lot.

6. Any third-party representative bidding on behalf of a third party is personally responsible for any purchase made.

8. All Sales Are Final: All sales are final. Quantities and conditions must be checked before removal from Bunting, as adjustments will not be made after removal from the premises.  The purchaser assumes full responsibility for items at the fall of the hammer. Bunting Auctions is not responsible for the loss of any item or for damage to a lot after the lot is pronounced sold. This includes but is not limited to any damage incurred from storage or movement in our warehouse, while loading, during transport / delivery or when removing any lot stickers or identifying tags. Bunting Auctions will in no way be liable for damage caused to any person or their property by any item or its contents once it is pronounced sold. 

14. Forms of Payment: Visa, Master Card, or you Discover Credit Card on file. Credit Cards are AUTOMATICALLY CHARGED IMMEDIATELY AFTER THE AUCTION CONCLUDES, you will receive an invoice shortly afterwards. 

Should the payment method be declined, all purchases MUST BE PAID FOR WITHIN 48 HOURS of the conclusion of the auction (9pm SATURDAY), NO EXCEPTIONS.

Payment may also be made via cash at our facility, we do not accept, WE DO NOT ACCEPT PAYPAL, ZELLE, CASHAPP or VENMO ECT. Call (301) 298-9300 with any questions prior to the end of the auction.

12. Internet purchases from Bunting Auctions will be subject to sales tax. We fully comply with sales tax NEXUS laws and YOUR PURCHASE IS SUBJECT TO SALES TAX unless you are a tax-exempt reseller. Any sales tax shown on your invoice is collected and remitted by BUNTING. If you are tax exempt, you can submit your tax exempt certificate to VIA EMAIL to prevent the collection of tax. As required by law sales tax is charged on the TOTAL purchase price (Hammer Price + Buyers Premium).

13A. Bunting Auctions has a ZERO TOLERANCE Policy regarding non-paying bidders & will pursue all available options to collect on any unpaid invoices. Storage fees as outlined in the terms for this auction & legal/collection fees may also be added to past due invoices.

13B. Due to recent fraudulent activity Bunting Auctions reserves the right to deny certain types of payment or require payment via cas at their sole discretion for any reason. Please call us with any questions or concerns prior to bidding.

13C. Failure to pay for any within 10 days may be resold with no notice due to the buyer, and bidding privileges will be suspended. If a bidder requests for a suspension to be lifted and the item is no longer available, Bunting Auctions reserves the right to collect/retain the buyer's premium or $25 per lot, whichever is greater as a service fee for reinstating the account. Payment is expected in full, no payment plan or other arrangements will be made.

13D. In the event a chargeback / credit card dispute is initiated by the bidder no merchandise will be released until the chargeback / credit card dispute is settled & ALL storage fees are paid in full.

13F. Bidders must have a validated method of payment on file in order to be approved to bid in this auction. A bidder's account me be suspended for a low payment rate.

8. Any statement by the auctioneer or staff, written or oral, before, during or after the auction regarding condition, age or authenticity etc. are opinion only. It is the Bidders responsibility to ensure that the condition of the lots meet with their satisfaction BEFORE bidding.

Removal of Property. All purchases, upon payment, shall be removed from the premises within 48 of the close of the auction, at the Buyer’s expense. Bunting is not responsible for any property left on the premises after seven (7) days from the date of the applicable auction. After 7 days, all items are deemed abondande and become the property of Bunting Online Auctions. Packing and handling of purchased lots is at the entire risk of the Buyer. Bunting is not responsible for any work conducted by a third-party shipper.

9. Storage Fees: Without exception, for all merchandise left on the premises, Bunting will charge a storage fee of the greater of $20.00 per lot per. Bunting reserves the right to re-sell any item purchased and left in Bunting’s warehouse for over 7 days. In the event, you refuse to pay for or abandon any auction item that you win at auction, buyer agrees to pay all fees involved in the collection of the monies, including legal fees.

7. Some lots may not include accessories such as keys, shelves, hardware, rails, lids, brackets, crystals, prisms, weights, pegs etc. Bunting Auctions is not responsible for any missing accessories or incomplete lots. Buyers are advised to review photos and descriptions carefully to determine included accessories and to ask questions before bidding. If an accessory is shown in the photos or mentioned in the description, then it is part of the purchase. If an accessory is not shown in the photo or listed in the description, it is NOT part of the purchase. Please ask about any spare/replacement keys or accessories when picking items up as that is the time to have a chance of locating any spare or replacement accessories for any missing items. Please instruct delivery services to do the same & to handle keys/accessories with care.

SHIPPING We offer local pickup and in-house shipping on items small enough to ship regular mail.  Items must be shipped to the shipping address on your invoice.  Larger items requiring freight shipping must be coordinated by the buyer.  Bunting is happy to work with any freight shipper you choose.  In case of loss or mishandling by the carrier we will provide you with the tracking information and invoices so that you can file a claim. We do not file the claims ourselves.  Bunting is not responsible for the acts or omissions of carriers or packers, or the employees or agents of either, or of customs fees and practices, of purchased lots, whether or not recommended by Bunting. Packing and handling of purchased lots by Bunting is at the entire risk of the purchaser. Our shipping department works intensively after each auction to get items shipped as soon as possible. It still takes 10-14 business days after the auction to ship all the items, as there are many items to prepare after each auction and it takes time.

15. It is the responsibility of the buyer to remove purchased property at his or her expense after the auction, request shipping on packageable items, or to MAKE SHIPPING ARRANGEMENTS FOR ITEMS REQUIRING FREIGHT SHIPPING. Please note that shipping charges can be expensive, in some cases more than the cost of the item, it is strongly recommended that bidders obtain a quote prior to bidding. It is the buyer's responsibility to get any quotes & coordinate pick up of their item. IF YOU ARE UNABLE TO PICK YOUR ITEMS UP, USE OUR IN-HOUSE SHIPPING, OR ARE UNABLE OR UNWILLING TO COORDINATE SHIPPING OF YOUR ITEM YOU ARE ADVISED NOT TO BID. 16. BUNTING AUCTIONS IS NOT A STORAGE FACILITY. All items must be removed from Bunting Auctions premises or in-house shipping requested within TWO DAYS or have freight shipping arrangements in place (meaning you have a shipper set to pick up and they have given you a pickup date) within TEN (10) days following the auction. Notification of shipping arrangements or requests for additional time must be submitted via Email - Verbal/Phone notification is not acceptable. If you do not receive a reply from us confirming receipt of your message / email, then we did not receive it & you should continue to attempt to contact us.

14C. Bunting Auctions WILL NOT cancel the sale of item due to a price difference in a pre-auction shipping estimate and a post auction shipping estimate.

16A. Failure to remove the items within the allotted time will result in storage charges at the rate of $20 per lot, per day, starting at the date of sale. Once storage charges begin to accrue no items will be released until the storage charges are paid for in full. ANY ITEMS LEFT LONGER THAN 7 DAYS WITHOUT PRIOR WRITTEN/EMAILED AND AGREED TO ARRANGEMENTS WILL BE DEEMED ABANDONED AND MAY BE DISPOSED OF OR RESOLD WITH NO NOTICE GIVEN OR REFUND DUE TO THE ORIGINAL BUYER.

16B. Bunting Auctions DOES NOT generally accept the reconsignment of unwanted lots (in whole or in part) that customers purchased during one of our auctions. EXCEPTIONS will be considered for items selling for more than $20 on a case by case basis, with no guarantee.

17. ANYONE OR ANY DELIVERY SERVICE PICKING UP ITEMS FOR SOMEONE ELSE MUST PRESENT A COPY OF THE INVOICE(S) OR A DELIVERY ORDER/WAYBILL THAT SHOWS THE INVOICE NUMBER, NAME OF PURCHASER & LISTS ALL ITEMS BEING PICKED UP. This enables us to have a two-way verification system and ensure that all items are accounted for, and all the items are picked up. Bunting Auctions is NOT responsible for any costs or inconveniences caused due to incomplete deliveries. Pick up hours are Monday-Wednesday 10am- 5:30pm immediately following the auction’s close. No weekend pickup.

10. Consequences of Late Pick-up, Abandoned Property: Buyer hereby releases Bunting of and from any claims related to such Abandoned Property (including without limitation claims for purchase price refunds, possession of such lot, or other damages or losses). Buyer acknowledges and agrees that Bunting is not responsible for damage or loss that occurs to Abandoned Property and that Bunting is not responsible for insuring Abandoned Property after the Retrieval Period.

12. Default: If any conditions contained in this Conditions of Sale are not complied with by the Buyer, Bunting, in addition to all remedies available by law, including the right to hold such Buyer liable for the purchase price plus Buyer’s premium and applicable sale tax, may: (i) cancel the sale, retain as liquidated damages any payment paid by the Buyer; (ii) resell the property without reserve at public auction or privately, on seven (7) days’ notice to the Buyer; and (iii) take such other legal action as it deems necessary or appropriate. If Bunting resells the property, the original defaulting Buyer shall be liable for the payment of any deficiency in the purchase price and all costs and expenses, including storage fees, the expenses of both sales, attorneys’ fee incurred, incidental charges and all other charges due hereunder. Any Buyer who fails to comply with the conditions contained in this Agreement shall be deemed to have granted Bunting sole interest in any other property owned by such Buyer that is in Bunting’s possession. Bunting shall have the benefit of all rights of a secured party under the Maryland Uniform Commercial Code.

13. Attorneys’ Fees/Court Costs: Should any action be brought to enforce any of the terms and/or conditions set forth in this Agreement, the prevailing party shall be entitled to all court/arbitration costs and actual attorney’s fees incurred.

15. Changes to Terms and Conditions: Bunting has the right to update its terms and conditions. Any changes will be posted on Bunting's website at https://www.BuntingOnlineAuctions.com as well as on the auction registration page. Please review these terms and conditions regularly to ensure you are aware of any changes made by Bunting. If any Bidder and/or Buyer participates in a Bunting Online Auction after changes have been made and posted, the Bidder and/or Buyer shall be deemed to have agreed to such changes.

16. Arbitration of Disputes. All disputes which may arise between the Buyer and Bunting under or with respect to these Terms and Conditions shall be determined solely by arbitration in accordance with the rules of JAMS, applying Maryland law. The arbitration shall be held in Maryland. Such determination by the arbitrators or by the sole arbitrator, whatever the case may be, shall be final, binding, and conclusive upon the parties. The prevailing party shall be entitled to all costs and outside attorneys fees

incurred. Bidder agrees that all disputes arising under this agreement shall be brought exclusively in the Judicial District Courts of Calvert County, Maryland. Bidding on any item in the auction indicates the bidder's acknowledgement of & agreement to the above terms.

19. Abusive or Aggressive Behavior Policy.  Bunting Auctions has a Zero Tolerance policy regarding abusive or aggressive behavior. Harassment, Physical and/or Verbal abuse of our staff or customers in person, via telephone or electronic communication will not be tolerated. Should someone engage in abusive/aggressive behavior a warning may be given or the interaction may be ended. At our discretion they may be asked to leave, have communication blocked and/or not be allowed to return or participate in future auctions. We are a family run auction company that prides itself on great customer service. We treat everyone as we would want to be treated and simply ask that you do the same.

COMMUNICATION  Winning bidders email addresses will automatically be added to our inhouse mailing list. You may opt out by clicking the manage my subscription link at the bottom of any email you receive from us. By agreeing to the Terms and Conditions of the auction, you are agreeing to receive communication from Bunting via telephone, email, SMS Messages, text message and our newsletter for the purpose of sending reminders about invoices and pickups and for providing shipping and information. You may opt out at any time. The Auction is conducted under these Terms and Conditions of the Auction and applicable state and local law. Announcements and corrections from the podium and those made through the Terms and Conditions of Auctions appearing on the Internet at Buntingonlineauctions.com. 

 

By placing a bid, you consent to a $1 hold. It is a hold only, not a charge.

Late Pick Up.

A late pickup fee of 20$ will be added to all items not picked up during the pickup window, starting at the close of business on the final pickup day.
